This Policy describes how we treat user information we collect on EA Central and other offline sources. This Privacy Policy applies to current and former visitors to our website and to our online customers. By visiting and/or using our website, you agree to this Privacy Policy.

  1. Definitions

    The “Agreement” refers, collectively, to all the terms, conditions, notices contained or referenced in this document (the “Terms of Service” or the "Terms") and all other operating rules, policies of Tech Mahindra & its Products. 

    The “Service” or “Product” refers to the applications, software, products, and services provided by Tech Mahindra in relation to its Product. 

    “User Data” means all information and data collected by the Product, including any data, metadata, metrics, statistics, or other information relating to the performance, operations, resource, health, or other conditions of the Product and or resulting language distributions created by the Product, any component thereof (including third party components). 
    “You,” and “Your” refer to the individual person, company, or organization that has visited or is using the Tech Mahindra Product and or Service; that accesses or uses any part of the account

  2. Compliance with Laws and Regulations

    Your use of the Product and Service must not violate any applicable laws, including copyright or trademark laws, export control laws, or other laws in your jurisdiction. You are responsible for making sure that your use of the Product complies with laws and any applicable regulations. 
    If You are located outside of the United States, You further agree to comply with your own local laws regarding online conduct and acceptable content. 
    Each party shall comply with the export laws and regulations of the United States and other applicable jurisdictions in providing and using the Product. Diversion contrary to U.S. law is prohibited. Without limiting the foregoing, You agree that (1) You are not, and are not acting on behalf of North Korea, Sudan or Syria, or any other country to which the United States has prohibited export transactions; (2) You are not, and are not acting on behalf of, any person or entity listed on the U.S. Treasury Department list of Specially Designated Nationals and Blocked Persons, or the U.S. Commerce Department Denied Persons List or Entity List; and (3) You will not use the Product for, and will not permit the Product to be used for, any purposes prohibited by law, including, without limitation, for any prohibited development, design, manufacture or production of missiles or nuclear, chemical or biological weapons.

    Acceptable Use 
    You agree that you will not under any circumstances upload, post, host, or transmit any content that:

    • is unlawful or promotes unlawful activities;
    • is or contains sexually obscene content;
    • is libelous, defamatory, or fraudulent;
    • is discriminatory or abusive toward any individual or group;
    • contains or installs any active malware or exploits, or uses our platform for exploit delivery (such as part of a command and control system); or
    • infringes on any proprietary right of any party, including patent, trademark, trade secret, copyright, right of publicity, or other rights.

  3. Intellectual Property
    1. Rights to Content Tech Mahindra, its licensors, vendors, agents, and/or content providers retain ownership of all intellectual property rights of any kind related to the Product and Service and the Distributions. We reserve all rights that are not expressly granted to you under this Agreement or by law. You may not duplicate, copy, or reuse any portion of the content, media, HTML/CSS, Javascript, or visual design elements or concepts without express written permission from Tech Mahindra.
    2. Reservation of Rights. Subject to the limited rights expressly granted hereunder, Tech Mahindra reserves all right, title and interest in and to the Product and Distributions, including all related intellectual property rights. No rights are granted to You hereunder other than as expressly set forth herein.
    3. Restrictions. You shall not (i) create derivative works based on the Product and or the Distributions, (ii) copy, frame or mirror any part or content of the Product, other than copying or framing on Your own intranets or otherwise for Your own internal business purposes, (iii) copy, frame or mirror any part or content of the Distributions except as specified in applicable license agreement attributable to the relevant Distribution, (iv) reverse engineer the Product and or any Distributions, or (v) access the Product in order to (a) build a competitive product, or (b) copy any features, functions or graphics of the Product. You shall not (i) permit any third party to access the Product or (ii) frame or mirror any third party content of the Product, other than copying or framing on Your own intranets or otherwise for Your own internal business purposes.
    4. Ownership of User Data. As between Tech Mahindra and You, You exclusively own all right, title and interest in and to all of Your User Data. You will be solely responsible for the accuracy, quality, integrity and legality of Your User Data and of the means by which You acquired User Data
    5. Open Source Software The Product may include or use open source software components and or you may utilize additional open source software components, each of which is licensed to You under its own applicable license terms and conditions, which can be found in the license file or the corresponding source files for such software component. You acknowledge that Your own distribution or deployment of instances containing or linking to the Distribution and or Service including the open source components, or any other open source software, may trigger open source license requirements for which You are responsible. Nothing in this Agreement limits Your rights under or grants rights to You that supersede the terms of any applicable open source software license for the applicable open source components. You are responsible for complying with open source license requirements.
  4. Confidential Information

    "Confidential Information" shall mean all trade secrets, know-how, inventions, techniques, processes, algorithms, software programs, hardware, schematics, planned product features, functionality, performance and software source documents relating to Product, and other information provided by Tech Mahindra, whether disclosed orally, in writing, or by examination or inspection, other than information which You can demonstrate (i) was already known to You, other than under an obligation of confidentiality, at the time of disclosure; (ii) was generally available in the public domain at the time of disclosure to You; (iii) became generally available in the public domain after disclosure other than through any act or omission of You; (iv) was subsequently lawfully disclosed to You by a third party without any obligation of confidentiality; or (v) was independently developed by You without use of or reference to any information or materials disclosed by Tech Mahindra or its suppliers. You shall not use any Confidential Information for any purpose other than as expressly authorized under this Agreement. In no event shall You disclose any Confidential Information to any third party. Without limiting the foregoing, You shall use at least the same degree of care that You use to prevent the disclosure of your own confidential information of like importance, but in no event less than reasonable care, to prevent the disclosure of such Confidential Information.

  5. Disclaimer of Warranties

    Tech Mahindra provides the Product and the Service “as is” and “as available,” without warranty of any kind. Without limiting this, we expressly disclaim all warranties, whether express, implied or statutory, regarding the Product and the Service including without limitation any warranty of merchantability, fitness for a particular purpose, title, security, accuracy and non-infringement. 
    Tech Mahindra does not warrant that the Service will meet your requirements; that the Service will be uninterrupted, timely, secure, or error-free; that the information provided through the Product and/or Service is accurate, reliable or correct; that any defects or errors will be corrected & that the Service will be available at any particular time or location; or that the Service is free of viruses or other harmful components. You assume full responsibility and risk of loss resulting from your downloading and/or use of files, information, content or other material obtained from the Service.
    No advice or information, whether oral or written, obtained by you from Tech Mahindra or through or from the Product shall create any warranty not expressly stated herein.

  6. Indemnification

    If you have a dispute with one or more Users, you agree to release Tech Mahindra from all claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes. You agree to indemnify, defend and hold Tech Mahindra harmless from and against any and all claims, liabilities, and expenses, including attorneys’ fees, arising out of your (a) use of the Product and the Service, including but not limited to your violation of this Agreement, (b) breach of confidentiality obligations (c) your use of Product and Service causing any third party IP infringement claim provided that Tech Mahindra (1) promptly gives you written notice of the claim, demand, suit or proceeding; (2) gives you sole control of the defense and settlement of the claim, demand, suit or proceeding (provided that you may not settle any claim, demand, suit or proceeding unless the settlement unconditionally releases Tech Mahindra of all liability)

  7. Limitation of Liability

    You understand and agree that Tech Mahindra will not be liable to you or any third party for any loss of profits, use, goodwill, or data, or for any incidental, indirect, special, consequential or exemplary damages, however arising, that result from: 

    1. the use, disclosure, or display of your User-Generated Content;
    2. your use or inability to use the Service;
    3. any modification, price change, suspension or discontinuance of the Service;
    4. unauthorized access to or alterations of your transmissions or data;
    5. statements or conduct of any third party on the Service;
    6. any other user interactions that you input or receive through your use of the Service; or 
      Tech Mahindra will have no liability for any failure or delay due to matters beyond our reasonable control.

  8. MISCELLANOUS
    Governing Law

    Except to the extent applicable law provides otherwise, this Agreement between you and Tech Mahindra and any access to or use of the Product or the Service are governed by the laws of the State of New York without regard to its conflict of law provisions. You and Tech Mahindra agree to submit to the personal and exclusive jurisdiction of the courts located in Southern District, State of New York.

  9. Data

    EA Central Stores and process the customer and their user’s data only for providing Education training courses we do not share this data with any third party or use it for any other motive. 

    • What data is collected and retained as per retention policy 

    1. From Clients of EACentral à Organization Name, organization Domain, SSO Login URL, and authentication type for their organization Users 

    1. From application User àUsername (User can set this), Email, First name, Surname, City/Town, and Country 

    1. Apart from these we also store their course enrolment, status of completion of a course, and/or curriculum which falls under User and application-related PI 

    • The format in which it should be kept 

    Data is strictly stored in Digital format we have AWS Servers in Oregon to help us store and process data securely, as per application need, we store data in MySQL DB for application to access and in Backups that are scheduled every week retained up to the past 3 weeks and monthly backups retained up to 2 months  

    • How long it should be stored for 

    We store data if he/she accesses the application (i.e. Login and use the application regularly) 

    However, there are two instances when we remove the data of the application user 

    1. When the user or user’s organization Requests to clear all the user data 

    1. When the user is inactive for more than 6 months (We make sure we remind the user for every week of inactivity via an email to the registered user) 
      NOTE: The data would be cleared once either of these events occur and the backups expire according to the above statement 

     

    • Who has the authority to dispose of data: 

    Product Owners of EACentral
